Alcohol

Alcohol limits
35 Micrograms in breath
80 Milligrams in blood
107 Milligrams in urine

In practice, no prosecution in borderline cases.

Random breath tests

Theoretically illegal. But don't bank on that as a defence. A police officer in uniform may require one if he or she reasonably suspects:

    a) That you have been riding/attempting to ride/in charge of your machine, with excess alcohol or whilst until through drugs or drink
    Or
    b) That you have been responsible for any of those things – and still have alcohol in your body.
    Or
    b) That you have committed a moving road traffic offence.

Alcohol defences

Very few.
Possibilities include:
Your drink had been "laced" without your knowledge
You were riding in an emergency – eg taking a casualty to hospital when there was no other possibility.
"Hip flask" defence – consumption of alcohol after the riding.

Alcohol proof
Roadside Test – merely confirms whether you may be over the limit.
Main Test – at police station and after arrest – usually by breath – using Lion Intoximeter/Alchoholyser etc.
  1. 2 Readings taken – the lower one is used.
  2. Readings of 41-50 micrograms open up option of replacing breath specimens with blood or urine. Take that opportunity.
